John P. Young represents Hoosiers, all over the state injured in drunk driving accidents. Mr. Young and his partners practice out of the Indianapolis law firm of Young and Young. We make it our business to travel the State in pursuit of the rights of our clients who have been injured or killed by drunk drivers in drunk driving accidents. We represent only the seriously injured or wrongfully killed Hoosiers. We know that Hoosiers want more than anything to be self sufficient, earn a living, take care of their families and worship as they see fit. We are proud to be the voice of these brave and stalwart Hoosiers.
Yesterday we talked about the collision in Indianapolis, on east 56th street near Brendonway. IMPD Officer David Bisard tested positive for alcohol shortly after the crash that killed Eric Wells and injured Mary Mills and Kurt Weekly. Ciesielski and a spokeswoman with the Marion County prosecutor’s office said additional details from the investigation will be released today. IMPD officials declined to confirm Bisard’s blood-alcohol level, but Wells’ father said the family received word from the prosecutor’s office that Bisard’s blood-alcohol level tested at 0.19. Under Indiana law, a driver is presumed drunk at 0.08.
Our sympathy and concern go out to the families hurt by this Officer’s actions. These families may well be prohibited from obtaining fair compensation for their losses because of the Tort Claims Immunity we discussed yesterday. It would be hard to believe that the City of Indianapolis would hide behind this immunity, given that the officer was drunk. However, it is a common tactic for government to hide behind this law. It may be possible, that if the City of Indianapolis does try to hide behind this law, that they may bring a claim based on a Federal statute that allows recovery when a government employee interferes with that person’s civil rights while acting in their official capacity with the government. In this situation, it certainly sounds like the officer was acting, albeit drunk, in his official capacity. It is our stand the City of Indianapolis should make up for the harm this officer caused these families. City Of Indianapolis, do right by these families.
