breathalyzerThere are two issues in a drunk driving accident case.  The first asks: Is the driver operating the vehicle under the influence of alcohol?   The second is the level of impairment caused by that alcohol. In most cases, the police officer is called to the scene of a collision and begins the investigation.  The investigation includes observing the driver of the car that caused the collision.  This observation is for slurred speech, glassy eyes, odor of alcohol et cetera. (These observations serve the purpose of allowing the officer to test the driver, probable cause, and as evidence of impairment if the alcohol test comes back positive).  If the officer has reason to believe the driver has been drinking this gives the officer probable cause to test the driver.

There are two sets of tests the officer will perform.  The first set is to test for alcohol in the driver’s system.  This can be in the form of a breath test (breathalyzer) or a blood test which is usually performed at a hospital.  If the initial breath test demonstrates the presence of alcohol, the officer will conduct field sobriety tests to determine if the driver is impaired.  If the officer is satisfied that the results of these tests indicate the driver is drunk the driver will be arrested and either taken to jail or to the hospital for further tests.

Once the blood and or breath alcohol level is known, additional information can be gathered to help demonstrate the level impairment.  This information may be important when the claim is that the drunk driver was served alcohol at a bar after he/she was already visibly impaired.  This kind of claim against the bar is called a “Dram Shop Action”.  We will talk more about a Dram Shop Action next time.
